Acceptance of Terms
By accessing or using the Get Pass Point visitor management platform, whether as a visitor, customer, administrator, or any other user, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy and Cookie Policy, which are incorporated herein by reference and form an integral part of this agreement.
These Terms constitute a legally binding agreement between you (the user) and Get Pass Point (the service provider), governing your access to and use of our platform, services, features, content, and applications, whether accessed via web browser, mobile application, or any other means now known or hereafter developed.
If you are using this service on behalf of an organization, company, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and references to "you" and "your" shall refer to both you as an individual and the organization you represent.
We reserve the right to modify, amend, update, or replace these Terms and Conditions at any time without prior notice, and your continued use of the platform following any such changes constitutes your acceptance of the new Terms, therefore we recommend that you review this page periodically to stay informed of any updates or modifications.
Service Description
Get Pass Point provides a comprehensive cloud-based visitor management system designed to streamline and digitize the process of visitor check-in, check-out, badge printing, host notifications, and visitor tracking for organizations, office buildings, residential complexes, educational institutions, healthcare facilities, and other premises requiring secure visitor management and access control.
While we strive to ensure uninterrupted service availability, we do not guarantee that the platform will be available at all times or that it will be error-free, as technical issues, maintenance activities, internet connectivity problems, or circumstances beyond our control may occasionally cause service interruptions, and we shall not be liable for any losses or damages arising from such unavailability.
We reserve the right to modify, suspend, discontinue, or terminate any feature at any time, with or without notice, provided that such changes shall not materially diminish the core functionality promised under your active subscription plan.
User Accounts and Registration
To access certain features of the Get Pass Point platform, organizations and administrators must create an account by providing accurate, complete, and current information including organization name, address, contact details, authorized administrator information, and payment details, and you agree to update this information promptly if it changes to ensure we can contact you and provide uninterrupted service.
Security Responsibility
You are responsible for maintaining the confidentiality of credentials, using strong passwords, enabling 2FA, and notifying us of any security breaches.
Proper Usage
Each account is for a single organization. You may not share credentials outside authorized administrative channels.
You are fully responsible for all activities that occur under your account, whether authorized by you or not, including any actions taken by employees, contractors, or visitors using systems connected to your account, and you agree to indemnify and hold us harmless from any claims arising from security failures on your end.
Visitor Obligations and Conduct
All visitors using the Get Pass Point check-in system must provide truthful, accurate, and complete information during the registration process, including their full legal name, contact details, purpose of visit, host information, valid government-issued identification when requested, and any other information reasonably required for security and compliance purposes.
Visitors consent to having their photograph taken, information recorded, and data processed as part of the visitor management process, acknowledging that such information may be retained for security, compliance, and record-keeping purposes in accordance with applicable laws and the visiting organization's policies, and that this data may be shared with building security, law enforcement, or regulatory authorities when legally required.
Visitors must wear badges visibly, limit access to authorized areas, follow escort requirements, and adhere to emergency procedures.
False information or circumventing security will result in immediate revocation of access and potential legal action.
Customer Obligations and Subscription
Organizations subscribing to Get Pass Point services are responsible for ensuring that their use of the platform complies with all applicable local, state, national, and international laws, regulations, and industry standards, including but not limited to data protection laws, employment regulations, building codes, fire safety requirements, and accessibility standards.
Data Controller Status
Customers acknowledge that they are the data controllers responsible for ensuring lawful processing of personal information and obtaining all necessary consents and legal authorizations.
Subscription fees are billed in advance on a monthly, quarterly, or annual basis as selected during registration, and customers agree to pay all fees in a timely manner. Failure to make payment by the due date may result in service suspension, account deactivation, late fees, or termination of services with potential loss of data.
Customers are responsible for maintaining adequate internet connectivity, compatible hardware/software, and necessary IT infrastructure to support the operation of our services.
Payment Terms and Billing
All payments for Get Pass Point services must be made through our authorized payment gateways using valid payment methods including credit cards, debit cards, net banking, UPI, or other options we may offer. You authorize us to charge your designated payment method for all fees and applicable taxes.
Non-Refundable: Subscription fees are non-refundable except as expressly provided in our refund policy or required by law.
Pricing Changes: We reserve the right to modify pricing with at least 30 days' advance notice affecting your current subscription.
Failed payments may result in account suspension, late fees, and collection agency engagement.
Intellectual Property Rights
All content, features, functionality, software code, designs, graphics, and trademarks available through the Get Pass Point platform are owned by us, our licensors, or our content providers and are protected by international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for internal business purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works without our express written permission.
You retain all ownership rights to the data you upload (visitor records, employee data), but you grant us a worldwide license to use and process such data solely for the purpose of providing services and improving platform functionality.
Data Protection and Privacy
We implement industry-standard technical and organizational security measures including encryption, access controls, secure data centers, and regular audits to safeguard data against unauthorized access or destruction.
We process personal data in accordance with our Privacy Policy and applicable laws including the Information Technology Act 2000 and relevant Indian data protection regulations, ensuring data is collected lawfully and retained only as long as necessary.
In the event of a data breach, we will notify affected customers and individuals in accordance with applicable breach notification laws, cooperate with investigations, and take immediate remedial measures to contain the breach.
Prohibited Uses and Conduct
You agree not to use the platform for any unlawful purpose or to facilitate illegal activities. Prohibited activities include but are not limited to:
- Unauthorized hacking or gaining access to other accounts.
- Using automated systems, scrapers, or bots to extract data.
- Transmitting malware, harmful code, or abusive materials.
- Infringing IP rights or violating privacy/harassment laws.
Service Availability and Maintenance
While we strive for reliable, uninterrupted service, we do not guarantee 24/7 availability. We may perform scheduled maintenance, emergency repairs, or upgrades that temporarily interrupt service.
Force Majeure
We are not responsible for failures caused by factors beyond our control (ISP outages, power failures, natural disasters, cyberattacks, or government actions).
We maintain backup and disaster recovery systems, but customers are strongly encouraged to maintain their own backup copies of critical visitor and business records.
Third-Party Services and Integrations
Get Pass Point may integrate with or provide links to third-party services, applications, websites, or content providers including payment gateways, SMS providers, email services, access control systems, background check services, and other external platforms that enhance or complement our visitor management functionality, and your use of such third-party services is subject to their respective terms of service and privacy policies.
We do not control, endorse, or assume responsibility for any third-party services, and we make no warranties or representations regarding the accuracy, reliability, functionality, security, or quality of such external services, and you acknowledge that your interactions with third-party providers are solely between you and those providers, and we shall not be liable for any damages or losses arising from such interactions.
When you integrate third-party services with Get Pass Point, you may be required to provide additional permissions, authorize data sharing, or agree to additional terms and conditions imposed by those third parties, and you are responsible for reviewing and understanding the privacy practices, security measures, and terms of service of any third-party applications or services you choose to integrate with our platform.
We reserve the right to discontinue support for any third-party integration at any time without notice if such integration poses security risks, violates our policies, becomes technically incompatible, or if our relationship with the third-party provider is terminated, and we shall make reasonable efforts to notify customers of such discontinuations when practicable.
Limitation of Liability
Maximum Extent limitation
To the maximum extent permitted by applicable law, Get Pass Point shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, or goodwill.
Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the liability event, or $100 USD (whichever is greater).
Indemnification
You agree to defend, indemnify, and hold harmless Get Pass Point against all claims, damages, liabilities, and expenses (including attorney's fees) arising from your use/misuse of the platform, violation of these Terms, infringement of third-party rights, or violation of applicable laws governing visitor management and data protection.
Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the platform will meet specific requirements, be 100% bug-free, or remain compatible across all network terrains and devices at all times.
Termination and Suspension
We reserve the right to suspend or terminate access immediately for breach of terms, non-payment, fraudulent activity, or security violations.
Cancellation: You may terminate your account at any time, staying responsible for fees through the end of the current billing cycle.
Data Recovery: We allow a roughly 30-day window to export data post-termination before permanent deletion (subject to legal retention overrides).
Governing Law and Dispute Resolution
These Terms shall be governed by the laws of India. Disputes will first undergo a 30-day good-faith negotiation period.
Unresolved disputes shall be settled through binding arbitration in Surat, Gujarat, India under the Arbitration and Conciliation Act, 1996, conducted in English by a sole arbitrator.
General Provisions
These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Get Pass Point regarding your use of our platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to the subject matter hereof, and no other terms, conditions, or representations shall be binding unless expressly agreed to in writing by an authorized representative of Get Pass Point.
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect, and the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing, and no waiver of any breach or default shall constitute a waiver of any subsequent breach or default, and all rights and remedies shall remain cumulative and may be exercised singularly or concurrently at our discretion.
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this provision shall be void and of no effect, whereas we may freely assign or transfer our rights and obligations under these Terms to any affiliate, successor, or third party in connection with a merger, acquisition, corporate reorganization, or sale of assets without your consent or prior notice.
